SEASON TICKET/CARD - CONDITIONS OF ISSUE

1. Issue of Season Ticket

1.1 The issue of a Season Ticket and subsequent access to Boundary Park is subject to the Terms & Conditions of Entry found on this page.

1.2 Season Tickets are for the use of supporters of Oldham Athletic AFC (OAFC) only. By applying for a Season Ticket and/or using the same you hereby warrant and represent that you are a supporter of OAFC.

1.3 The age of applicants on 31st August 2024 will determine discount qualification for season ticket(s). The age categories are as follows;

Concession 18 - 21 Years Old & 65 Years Old and Over
Youth 14 - 17 Years Old
Junior* 7 - 13 Years Old
Child* 6 Years Old and Under

*Tickets must be purchased with an Adult/Concession Season Ticket

 

2. Admission to Boundary Park

2.1 By purchasing and/or accepting and/or holding a Season Ticket and/or using a Season Ticket to gain access to Boundary Park, you: (a) certify that you have read, understood and accepted; (b) agree to be bound by and to comply with; and (c) agree to bring to the attention of others, as required below, the Terms & Conditions of Entry.

2.2 A Season Ticket permits you to occupy at the Match the seat indicated on the Season Ticket or such other alternative seat of equivalent value as OAFC may, from time to time, allocate to you at its reasonable discretion. Oldham Athletic AFC reserves the right to relocate Season Ticket holders to a seat of similar standard to the one purchased at any time of the season for operational reasons. For example, without limitation, to facilitate ongoing stadium improvements and construction.

All access to Boundary Park pursuant to a Season Ticket shall be for the purposes of private enjoyment of the Match only, not for any commercial purpose (and no authorisation is given or implied in respect of the carrying out of any commercial activities).

2.3 Nothing in these Conditions of Issue shall constitute or imply any entitlement to occupy the seat indicated on the Season Ticket in any subsequent season.

2.4 Save as set out in clause 2.5 below, you shall not bring into or use within Boundary Park, or otherwise provide to, facilitate or otherwise assist any other person to use within Boundary Park, any equipment or technology that is capable of capturing, logging, recording, transmitting, playing, issuing, showing or otherwise communicating (by digital or other means) any audio, visual or audio-visual material or any information or data in relation to the Match or any aspect of it ("Material"). Any person acting in breach of this provision may have such equipment or technology confiscated and/or will be required to deliver up any tapes, films, disks, memory cards, memory sticks or other recordings of the Material (and all copies thereof) in whatever form, to the National League and/or OAFC and the copyright, database right and all other rights, title and interest in and to all Material is hereby assigned to the National League, including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988.

2.5 Mobile telephones are permitted within Boundary Park, provided that they are used for personal and private use only (which, for the avoidance of doubt, shall not include the capturing, logging, recording, transmitting, playing, issuing, showing or otherwise communicating of any Material for any commercial purpose).

2.6 Save for official OAFC merchandise and/or other football-related clothing worn in good faith, you shall not bring into, use, wear, or display within Boundary Park any sponsorship, promotional or marketing materials.

2.7 You shall not offer or distribute (either free or for sale by any person) within Boundary Park any consumer article or commercial product of any nature. For the avoidance of doubt this clause shall not prevent the lawful distribution of text publications in any format which do not infringe clause 2.6 above where both the content and the publication are lawful in all respects and do not in OAFC’s reasonable opinion constitute a threat to public order.

2.8 OAFC reserves the right to refuse admission to, or eject from, Boundary Park any person who fails to comply with the Terms & Conditions of Entry.

2.9 Without prejudice to the representation at clause 1.2 above, and in light of the Season Ticket holders being grouped together in designated areas, any attempt to gain access to Boundary Park wearing or carrying apparel (including, without limitation, hats and/or scarves) that demonstrate support for the Away Club, may result in admission being refused or you being ejected from Boundary Park and in such circumstances no refund or alternative seat will be offered.

 

3. Use of Season Ticket

3.1 Season Tickets may not be resold or lent for value by Season Ticket holders under any circumstances. You shall not use the Season Ticket for any commercial purpose. The reference to selling the Season Ticket includes: (a) offering to sell a Season Ticket (including, without limitation, via any website or online auction site); (b) exposing a Season Ticket for sale; (c) making a Season Ticket available for sale by another person; (d) advertising that a Season Ticket is available for purchase, which for the avoidance of doubt (and by way of example only) means that this Season Ticket may not be offered as a prize in any promotion or competition; (e) transferring, lending or selling a Season Ticket to any third party as part of a hospitality or travel package; and (f) giving (or offering to give) a Season Ticket to a person who pays or agrees to pay for some other goods or services (or offers to do so); all save as expressly authorised by the National League or OAFC.

3.2 The unauthorised sale or disposal of a Season Ticket may amount to a criminal offence under section 166 of the Criminal Justice and Public Order Act 1994, as amended by the Violent Crime Reduction Act 2006. OAFC will inform the police when it becomes aware that a Season Ticket has been sold or disposed of illegally and will press for charges to be brought against those breaking this law. If you are convicted of a ticket touting offence, or we reasonably suspect you have committed such an offence, we will notify the PL who may in turn notify other clubs and/or the relevant law enforcement authorities. The information that we share may include your personal details, information about the offence and about ticket purchases (including payment details). We will use this to identify and prevent ticket touting offences and disorder at matches.

3.3 The Season Ticket will remain the property of OAFC at all times and must be produced together with evidence of your identity if required to do so by any official, steward or employee of OAFC or any police officer. OAFC reserves the right to require the immediate return of the Season Ticket at any time.

3.4 Any Season Ticket obtained or used in breach of the Terms & Conditions of Entry shall be automatically void and all rights conferred or evidenced by such Season Ticket shall be nullified. Any person seeking to use a Season Ticket in breach of the Terms and Conditions of Entry in order to gain entry to Boundary Park or remain at a Match may be considered to be a trespasser and may be refused entry to, or ejected from, Boundary Park in respect of a particular Match.

3.5 In the event of any Season Ticket being cancelled, deactivated or withdrawn, in accordance with clause 3.4, no refund shall be payable to the holder in respect of any unexpired portion of the Season Ticket.

 

4. Changes to Dates, Refunds & Exchanges

4.1 No guarantees can be given by OAFC that a Match will take place at a particular time or on a particular date. OAFC reserves the right to reschedule any Match without notice and without any liability whatsoever. Your Season Ticket will enable you to attend the re-arranged Match.

4.1(a) OAFC are not obliged to offer refunds for Season Tickets when home matches are not permitted to take place beyond the control of the Club.

4.2 OAFC will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, loss of enjoyment or travel/accommodation costs.

4.3 The season ticket allocated to you by Oldham Athletic Football Club is for the stated seat, and may not be able to be exchanged.

 

5. Lost or Stolen Season Tickets

5.1 In order to gain admission to Boundary Park, the Season Ticket/card must be presented in its entirety at every Match.

5.2 In the event that you forget your Season Ticket in respect of any individual Match, OAFC shall not be obliged to admit you or issue any other form of ticket for that Match. If a match-day duplicate ticket is issued, OAFC may require payment of a non-refundable administration charge.

5.3 If a Season Ticket is damaged, lost, stolen or destroyed, a duplicate Season Ticket shall be issued by OAFC as soon as reasonably practicable after the payment of a non-refundable administration charge (£10). In making its decision, OAFC shall be entitled to call for all reasonable evidence of the need for a replacement Season Ticket, for example but not limited to a police crime reference number in the event that a Season Ticket is stolen, or a copy of the damaged Season Ticket.

5.4 Should any Season Ticket when applied for not arrive in the post after purchase, you will be required to sign a document confirming this and undertaking to immediately return the original Season Ticket to OAFC should it come into your possession at any time. There will be no charge for the issue of a duplicate Season Ticket in this instance.

 

6. Change of Address

If you change your address during the season you must notify OAFC as soon as reasonably practicable.

 

7. Cancellation, Deactivation and Withdrawal of Season Ticket

7.1 Without prejudice to clauses 3.4 and 3.5 or any other remedies it may have, OAFC shall have the right in the case of any serious or persistent breach of the Terms & Conditions of Entry to cancel, deactivate and/or withdraw your Season Ticket. In the event of such cancellation, deactivation and/or withdrawal no refund will be paid in respect of any unexpired portion of the Season Ticket. Without prejudice to the general nature of the above the following actions shall constitute serious breach of the

Terms & Conditions of Entry:

7.1.1 smoking inside the stadium (including, for the avoidance of doubt, the smoking of electronic cigarettes and any other vapour omitting substitutes);

7.1.2 being (or appearing to be) drunk or intoxicated;

7.1.3 persistent standing in seated areas whilst the Match is in progress;

7.1.4 the sale or transfer (save as permitted) of a Season Ticket to any person;

7.1.5 the possession of a banner or flag that bears material or slogans that are offensive, obscene, abusive or racist;

7.1.6 the supply of any misleading or incorrect information in any application;

7.1.7 the use of foul, obscene, abusive and/or racist language and/or gestures;

7.1.8 the throwing of any object within Boundary Park that may cause injury or damage to people or property without lawful authority or excuse;

7.1.9 the chanting of anything of an indecent or racist nature;

7.1.10 fighting or engaging in and/or inciting violence;

7.1.11 bringing into Boundary Park (or using within Boundary Park): illegal drugs, other illegal substances, fireworks, firecrackers, smoke canisters, air horns, flares, laser devices, bottles, glass vessels or any item that might be used as a weapon or compromise public safety;

7.1.12 entering the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse;

7.1.13 any misrepresentation in relation to clause 1.2 above;

7.1.14 breach of the terms of any Membership;

7.1.15 any breach of clauses 2.4, 2.5 or 2.6 above; and

7.1.16 any failure to pay or default of payment in respect of any sums owing to OAFC (or any third party) in respect of any Season Ticket.

7.2 OAFC may conduct security searches where it has reason to believe that any of the breaches set down in 7.1 has either occurred or may occur.

7.3 If a Season Ticket holder is not 16 years old or over, his/her parent(s) and/or guardian(s) are responsible for his/her actions, conduct and compliance with the Terms and Conditions of Entry.

7.4 In accordance with OAFC’s safeguarding policy, children aged 14 years or under are not permitted to purchase a Season Ticket unless accompanied by his/her parent(s) and/or guardian(s) and must be accompanied by his/her parent(s) and/or guardian(s) at all times whilst in Boundary Park.

7.5 In the event that your Season Ticket is cancelled, deactivated and/or withdrawn OAFC reserves the right to exclude you from any membership scheme maintained or organised by OAFC and/or to disqualify you from applying for any Match ticket or season ticket at its discretion, and to notify FIFA, UEFA, The Football Association, the English Football League, the National League and/or other football clubs of such exclusion and/or disqualification (and the reason(s) for such exclusion and/or disqualification).

 

8. Filming, Photography & Taping

All Season Ticket holders who enter Boundary Park acknowledge that photographic images and/or video recordings (and/or stills taken from video recordings) may be taken of them and may also be used in televised coverage of the game and/or for promotional or marketing purposes by OAFC, the National League or others, and use of a Season Ticket to enter Boundary Park constitutes consent to such use.

 

9. Exclusion of Liability

9.1 OAFC hereby excludes any liability for loss, injury or damage to persons/property in or around Boundary Park except in respect of death or personal injury resulting from any negligence of OAFC or any other liability of OAFC which cannot be excluded under applicable law.

9.2 Neither The National League nor OAFC shall be responsible for any interruptions and/or restrictions to the view of the Match caused by virtue of (a) the position of the seat and/or (b) the actions of other spectators.

 

10. General

10.1 OAFC reserves the right to change these Conditions of Issue from time to time, and shall notify you of such changes if they materially affect your rights as a consumer.

10.2 You consent to OAFC holding and processing data relating to you for administrative and legal purposes. The personal data that you provide to OAFC shall be processed, stored and transferred in accordance with the terms of OAFC's privacy policy available upon request to OAFC.

10.3 The invalidity or partial invalidity of any provision of these Conditions of Issue shall not prejudice or affect the remainder of these Conditions of Issue, which shall continue in full force and effect. If any invalid, unenforceable or illegal provision of these Conditions of Issue would be valid, enforceable and legal if some part of it were deleted, the provision shall apply with the minimum modification necessary to make it legal, valid and enforceable.

10.4 OAFC’s failure to exercise, or delay in exercising, any right, power or remedy provided by these Conditions of Issue or by law shall not constitute a waiver of that right, power or remedy.

10.5 The Terms and Conditions of Entry constitute the entire agreement between OAFC and the Season Ticket holder and neither OAFC nor the Season Ticket holder shall have any claim or remedy in respect of any statement, representation, warranty or undertaking made by or on behalf of any other party in relation to the Terms and Conditions of Entry which is not set out therein.

10.6 Notwithstanding any other provision in these Conditions of Issue and with the exception of FIFA, UEFA, The FA, and the English Football League, no other person other than you or OAFC has any rights under the Contracts (Rights of Third Parties) Act 1999 to rely on or enforce any term of these Conditions of Issue. Nothing in these terms of conditions shall affect any right or remedy of a third party that exists or is available other than as a result of the aforementioned Act.

10.7 These Conditions of Issue and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. The parties hereby submit to the exclusive jurisdiction of the Courts of England and Wales in relation to any dispute or claim arising out of or in connection with these Conditions of Issue (including in relation to any non-contractual disputes or claims).

 

11. Definitions

In the Conditions of Issue the following words and phrases shall have the following meanings:

“Away Club” means the football club playing against OAFC.

"Conditions of Issue" means these terms and conditions governing the issue and use of a Season Ticket.

"Ground" means Boundary Park and all other locations owned, occupied or utilised by OAFC.

"Ground Regulations" means those ground regulations issued by OAFC from time to time that set out the terms and conditions upon which spectators are granted entry to Boundary Park.

"Guest" means a relative, friend, colleague and/or companion to the disabled who would be entitled to purchase a Season Ticket under the Terms & Conditions of Entry.

"Match" means association football fixture (National League, FA Cup, FA Trophy and pre-season games) in which OAFC participates and that takes place at Boundary Park during the relevant season.

“Membership” means any rules and regulations agreed in relation to your participation in OAFC’s membership scheme which can be found at oldhamathletic.co.uk

"Season Ticket" means a season ticket booklet (and all or any component vouchers therein) or any season ticket smartcard (and/or any rights arising out of or in connection with any of the foregoing) for admission to Matches.

"Terms & Conditions of Entry" means each of the rules and regulations of FIFA, UEFA, The Football Association and the National League; Boundary Park Regulations; and the Conditions of Issue.

If you already have a Season Card but would like to change your seat when you renew please click here and choose an alternative available seat. You can also change seat when renewing your Season Card at the ticket office or by calling 0161 785 5150.

 

YOUR SEASON CARD / ACCESS CONTROL

If the unlikely situation occurs where there is a technical fault with your card, you will be asked to return to the ticket office who will provide you with a paper ticket to gain entry.

Fans are reminded that to attempt to enter Boundary Park using someone else’s card, without OAFC's permission or under the incorrect price band, is a fraudulent offence.

Anyone who would like to upgrade their season ticket must do by close of business the day before matchday.

Anyone found to be attempting to enter the stadium under the incorrect price band on a matchday will be asked to report to the Ticket Office, pay the full cost for the correct price band season or matchday ticket. Until this process is complete, you will not be granted access to Boundary Park.

 

GROUND REGULATIONS

Notice: Entry to Boundary Park is expressly subject to acceptance by the visitor of these Ground Regulations and the rules and regulations of FIFA, UEFA, The Football Association and the National League in respect of the relevant competition. Boundary Park Regulations incorporate OAFC's Customer Charter (if any). Entry to Boundary Park shall constitute acceptance of Boundary Park Regulations.

"Ground" means this football stadium and all locations owned, occupied or utilised by OAFC.

"Club" means Oldham Athletic AFC.

"Match" means any association football match, including pre-season friendlies (or any part or aspect of such a match) taking place at Boundary Park.

"Material" means any audio, visual and/or audio-visual material and/or any information or data.

“Football Authority” means each of the National League, The Football Association, FIFA, UEFA and any other relevant governing body of association football.

 

1. Notwithstanding possession of any ticket OAFC, any police officer or authorised steward may refuse entry to (or eject from) Boundary Park any person:

1.1 that fails (or in OAFC's reasonable opinion is likely to fail) to comply with these Ground Regulations or any reasonable instruction issued by a police officer or authorised steward or officer of OAFC; and/or

1.2 whose presence within Boundary Park is, or could (in OAFC's reasonable opinion), constitute a source of danger, nuisance or annoyance to any other person.

2. On no account will admission be granted to a person who is the subject of a current Banning Order under the Football Spectators Act 1989 (as amended) or has been convicted of ticket touting offences under the Criminal Justice and Public Order 1994 (as amended).

3. OAFC excludes to the maximum extent permitted by law any liability for loss, injury or damage to persons/property in or around Boundary Park.

4. No guarantees can be given by OAFC that a Match will take place at a particular time or on a particular date and OAFC reserves the right to reschedule the Match without notice and without any liability whatsoever, save only to the extent provided pursuant to paragraph 5.

5. In the event of the postponement or abandonment of the Match, refunds (if any) will be made in accordance with OAFC's Customer Charter. OAFC will have no further liability whatsoever, including (but not limited to) any indirect or consequential loss or damage, such as (but not limited to) loss of enjoyment or travel costs.

6. All persons seeking entrance to Boundary Park acknowledge OAFC's right to search any person entering Boundary Park and to refuse entry to or eject from Boundary Park any person refusing to submit to such a search.

7. The following articles must not be brought within Boundary Park - knives, fireworks, smoke canisters, air-horns, flares, weapons, dangerous or hazardous items, laser devices, bottles, glass vessels, cans, poles and any article that might be used as a weapon and/or compromise public safety. Any person in possession of such items will be refused entry to Boundary Park.

8. Further, you may not bring into Boundary Park:

8.1 any sponsorship, promotional or marketing materials save in respect of official club merchandise and/or other football related clothing worn in good faith;

8.2 any flags or banners larger than those maximum dimensions permitted by OAFC from time to time (or, in the absence of such stipulations, 2 metres x 1 metre) and/or of an offensive nature;

8.3 nor may you offer (either free or for sale by any person) any goods (including literature) of any nature, without the express written approval of OAFC's management.

9. The use of threatening behaviour, foul or abusive language is strictly forbidden and will result in arrest and/or ejection from Boundary Park. OAFC may impose a ban for one or more Matches.

10. Racial, homophobic or discriminatory abuse, chanting or harassment is strictly forbidden and will result in arrest and/or ejection from Boundary Park. OAFC may impose a ban for one or more Matches.

11. The following acts are offences under the Football (Offences) Act 1991 (as amended):

11.1 The throwing of any object within Boundary Park without lawful authority or excuse.

11.2 The chanting of anything of an indecent or racialist nature.

11.3 The entry onto the playing area or any adjacent area to which spectators are not generally admitted without lawful authority or excuse. Conviction may result in a Banning Order being made.

12. All persons entering Boundary Park may only occupy the seat allocated to them by their ticket and must not move from any one part of Boundary Park to another without the express permission or instruction of any steward, officer of OAFC and/or any police officer.

13. Nobody may stand in any seating area whilst play is in progress. Persistent standing in seated areas whilst play is in progress is strictly forbidden and may result in ejection from Boundary Park.

14. The obstruction of gangways, access ways, exits and entrances, stairways and like places is strictly forbidden. Nobody entering Boundary Park shall be permitted to climb any structures within Boundary Park.

15. All English Football League stadia are smoke-free and smoking or the use of electronic cigarettes is not permitted inside Boundary Park.

16. Mobile telephones and other mobile devices are permitted within Boundary Park PROVIDED THAT (i) they are used for personal and private use only (which, for the avoidance of doubt and by way of example only, shall not include the capturing, logging, recording, transmitting, playing, issuing, showing, or any other communication of any Material for any commercial purposes); and (ii) no Material that is captured, logged, recorded, transmitted, played, issued, shown or otherwise communicated by a mobile telephone or other mobile device may be published or otherwise made available to any third parties including, without limitation, via social networking sites.

17. Under the Sporting Events (Control of Alcohol etc.) Act 1985 (as amended), the following are offences for which a person can be arrested by a police officer and conviction could result in a Banning Order being made:

17.1 Attempting to enter Boundary Park or being inside Boundary Park whilst drunk;

17.2 Being in possession of any intoxicating liquor, or bottle, can or other portable container and which could cause damage or personal injury, when entering Boundary Park or in a public area of Boundary Park from which the event can be directly viewed.

18. Any individual who has entered any part of Boundary Park designated for the use of any group of supporters to which he does not belong may be ejected from Boundary Park either for the purposes of his own safety or for any other reason.

19. Save as set out in paragraph 16 above, no person (other than a person who holds an appropriate licence) may capture, log, record, transmit, play, issue, show or otherwise communicate (by digital or other means) any Material in relation to the Match, any players or other persons present in Boundary Park and/or Boundary Park, nor may they bring into Boundary Park or use within Boundary Park (or provide to, facilitate or otherwise assist another person to use within Boundary Park) any equipment or technology which is capable of capturing, logging, recording, transmitting, playing, issuing, showing or otherwise communicating (by digital or other means) any such Material.

20. The copyright, database rights and any other intellectual property rights in and to all Material that you produce at Boundary Park in relation to the Match, any players or other persons present in Boundary Park and/or Boundary Park (whether produced in breach of paragraph 19 above, or pursuant to paragraph 16 above, or otherwise) is hereby assigned  (including by way of present assignment of future copyright pursuant to section 91 of the Copyright, Designs and Patents Act 1988) to OAFC and the National League. You further agree (if and whenever required to do so by OAFC and/or the National League) to promptly execute all instruments and do all things necessary to vest the right, title and interest in such rights to OAFC and the National League absolutely and with full title guarantee.

21. No goods (including literature) of any nature may be offered either free or for sale by any person within Boundary Park without the express written permission of OAFC.

22. Tickets are not transferable and may not be offered for sale without the prior written permission of OAFC or otherwise in accordance with the relevant ticket terms and conditions. Any tickets that are transferred are transferred subject to these Ground Regulations. Any tickets offered for sale may be confiscated by any steward, officer of OAFC or any police officer. OAFC reserves the right to refuse admission to or eject from Boundary Park, and/or "blacklist", any person who has offered for sale or transferred his/her ticket in contravention of the relevant ticket terms and conditions (and/or the holder of any ticket that has been transferred in contravention of the relevant ticket terms and conditions). Tickets remain the property of OAFC at all times.

23. CCTV cameras are in use around and in Boundary Park.  Body worn video cameras recording video and/or audio may also be used as appropriate, to record images or audio which identifies you as an individual, for example to record prohibited behaviours as referenced in paragraphs 9 and 10. OAFC may itself use or pass to the police or any Football Authority or other clubs, any recordings for use in any proceedings.

24. At all times whilst present in Boundary Park, persons must comply with any and all instructions of any steward or officer of OAFC and/or any police officer. Failure to comply with any instruction may lead to immediate ejection from Boundary Park.

25. By entering Boundary Park, all persons are acknowledging that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds  (and/or stills taken therefrom ) may be taken of them and may also be used, by way of example and without limitation, in televised coverage of the game and/or for promotional, training, editorial or marketing purposes by OAFC, the National League or others  (including commercial partners and accredited media organisations)  and entry into Boundary Park constitutes  consent to such use. You further acknowledge that photographic images and/or audio, visual and/or audio-visual recordings and/or feeds (and/or stills taken therefrom) may be used (by OAFC or by a third party, such as a law enforcement body) to identify you as an individual, where permitted by data protection laws, for the purposes of preventing or detecting crime, or any breach of these Ground Regulations. Information about OAFC's use of your personal data will be brought to your attention by OAFC (see for example any applicable privacy policy, signage and/or other forms of announcement in or around Boundary Park). 26. All ticket holders agree that the Matches for which the tickets have been purchased are public, and that their appearance and actions inside and in the perimeter of Boundary Park where a Match occurs are public in nature, and that they shall have no expectation of privacy with regard to their actions or conduct at Matches.

27. Further to paragraph 25, if such person is under 18 years of age, the parent, guardian, or responsible adult who is accompanying them into Boundary Park shall be deemed to have provided consent on their behalf.

28. Refused entry to (or ejection from) Boundary Park may lead to further action by OAFC including, but not limited to, the withdrawal of any season ticket (without reimbursement), Club Membership and other benefits.
